The Kicks Sportwear firm has filed a lawsuit against Makhadzi and her production company, Open Mic Records, alleging that they violated the terms of their cooperation agreement.
The celebrated singer announced the release of her footwear line, Kokovha, in December 2021. Kicks Sportwear was a partner in this endeavor.
The firm claims that despite their agreement, the celebrity has refused to wear the sneakers to appearances and promote them on social media.
According to court documents obtained by Sunday World, the Kicks brand suffered a significant financial loss as a result of Makhadzi’s infringement.
The plaintiff therefore seeks R8 249 120 in damages for the following: The units of shoes in the warehouse were 6 900 pairs, 20 pairs of which were sold in Limpopo, leaving 6 880 pairs at the retail price they would have sold for. This is because the first and second defendants violated the partnership agreement.
The documents state that the plaintiff “suffered a terrible financial loss of R379 921 owing to the breach caused by the first and second defendants, which invoices were attached to the letter of demand that was delivered on the 6th of May 2022.”
The plaintiff also seeks compensation for any costs invested in upholding the terms and conditions of the partnership agreement and attempting to ensure the success of the launch of the limited edition brand.
The following is what Makhadzi has been mandated to pay:
“1. Payment of R8 629 041 in accordance with the letters of demand; 2. Payment of the [law] suit’s costs on an attorney-and-client scale; 3. Further and/or alternative redress.”
